CONDAMNATION DE XU NA EN APPEL

Mon amie Xu Na a été condamnée en appel pour participation à une organisation hérétique et promotion de matériel visant l'affaiblissement de la loi chinoise. Sur les faits on croit rêver (et c'est plutôt un cauchemar pour Na), imaginant que la possession de 53 flyers et de 11 CD menace un pays aussi grand et aussi puissant que la Chine. Comment, un petit bout de femme arriverait à mettre en danger avec ses petits poings et ses quelques matériaux de propagande une superpuissance militaro-financière. Réflexion aussi en écoutant le Dalaï Lama hier soir sur la 5, la douceur des propos de Océan de Sagesse, sa retenue et sa désaprobation permanente de la violence. Je me suis dit aussi, pourquoi la Grande Chine n'est-elle pas à même d'accorder à un petit pays comme le Tibet un statut spécial et d'accepter que les Tibétains pratiquent leur religion. Et si la question des quelques protestataires et des Tibétains n'était que l'arbre qui cache la forêt du désespoir moral en Chine. Les dirigeants du PCC ont toujours eu peur du phénomène de la pelote de laine. Si l'on dévide un fil, toute la pelote s'en va. Na et tous ceux qui souffrent en Chine pour leurs pratiques religieuses ne sont-ils pas victimes de cette problématique. Pauvre Na, bientôt 41 ans et encore deux ans à passer dans ces geôles, à être (probablement) battue, humiliée. Une artiste si douce, mais aussi une femme au caractère si trempé.
Tiens bon Na, nous ne t'oublions pas.

Ci-dessous je joins des extraits de la plaidoirie de l'avocat de Na (en anglais uniquement) Mr Cheng Hai du Cabinet d'Avocats Yitong de Beijing.

My friend Xu Na has been sentenced again to 3 years of jail in Beijing. The accusation from the Chongwen District Procuratorate is “using a heretical organization to undermine the implementation of the law,”. About facts, I am actually astonished. How is it possible for such a sweet and feable woman to threaten the Chinese Financial and Military Superpower and that the possession of 53 flyers and 11 CD's could endanger the development of China. If it was not a nightmare for Na, it would better to laugh about it. Listening yesterday evening to the Dalaï Lama (French TV Channel 5) I was impressed to check how this man is wise, always refusing violence and the so-called fight for independance, telling people, we must be moderate, we have to use the middle way and to have compassion even for our foes, the Chinese Government which oppresses and dominates the Tibetan people. Why China is not able to accept the religious freedom in Tibet. Tibet is a small country (around 6 millions persons) and China such a giant empire. Maybe the problem is not the Tibetan problem but what could happen in China itself if the Government accepts religious freedom in Tibet. Maybe the Chinese people would like also top enjoy the freedom to practice their religions. It could be like a wool ball, you pull just one ply, and everything is coming... Maybe it is one of the reasons why so many people are suffering in China...
Poor Na, almost 41, still two years to spend in the Chinese jails, being (probably) tortured and humiliated. She is such a sweet artist and such a strong woman.
Hold on Na! We 'll never forget you.

Below you will find out extracts of the defense led by the attorney appointed by Na, Mr Cheng Hai from Yitong Law Firm in Beijing City.

The accusation from the Chongwen District Procuratorate—“using a heretical organization to undermine implementation of the law,” e.g., spreading cult promotional materials, against the defendant is not based on facts.

Defense lawyer and chief judge Ma together reviewed the 11 copies of CD’s, and also briefly browsed through the 53 copies of letters, and the contents were mostly video recording of a spectacular show, the  persecution against Falun Gong followers, number of people who had withdrawn from the Chinese Communist Party (CCP), and suggestions for people to quit the CCP, all of which are within the boundary of freedom of speech granted by our country’s Constitution.

The accusation does not have legal basis.
The accusation stated that Xu Na was sentenced previously for making and spreading “Falun Gong” promotional materials. This time she again spread Falun Gong promotional materials. According to Article 300 of Criminal Law, “using a heretical organization to undermine implementation of the law” invokes criminal charges. And as a repeated offender within 5 years, harsh punishment should be implemented. The defense lawyer considered that the accusation did not specify which law enforcement was disturbed by Xu Na. Therefore it is not based on facts, nor does it have legal basis.
